DM Insta is a product operated by Ugenc AI, based in Mumbai, Maharashtra, India.

These Terms of Service (“Terms”) govern your use of the Ugenc AI platform (“Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

To use DmInsta, you must:

  • Be at least 18 years old
  • Use a valid Instagram Business/Creator account
  • Have the legal authority to grant permissions required by Meta APIs
  • Agree to all applicable Meta Platform policies

2. Use of the Service

Ugenc AI provides tools for:

  • Instagram DM automation
  • Chatbot workflows
  • Messaging management
  • AI-driven engagement tools

You agree not to use the platform for:

  • Spam or unsolicited messaging
  • Illegal or harmful activities
  • Violations of Instagram or Meta policies
  • Phishing, fraud, data scraping, or impersonation
  • Sending restricted content (hate, adult, dangerous activity, etc.)

3. Account Responsibilities

You are responsible for:

  • Maintaining accurate account information
  • Keeping login credentials secure
  • Ensuring your Instagram/Facebook permissions remain active
  • All actions performed through your account

4. Platform Availability

Service availability may depend on:

  • Instagram/Facebook API uptime
  • Token validity and permissions granted
  • Third-party system reliability

We do not guarantee uninterrupted service.

5. Subscriptions & Payments

  • Subscription fees must be paid on schedule
  • Taxes (such as GST) may apply under Indian law
  • Failed payments may result in temporary account suspension
  • No refunds for partial billing cycles unless explicitly stated
  • Pricing changes will be notified in advance

6. Intellectual Property

All platform content, branding, code, and features are owned by Ugenc AI.
Users receive a limited, non-transferable license to use the platform.

7. Data & Permissions

  • By using Ugenc AI, you grant us permission to:

    • Access data through Instagram/Facebook APIs
    • Receive and send messages on your behalf
    • Store relevant automation and message information

    You retain ownership of your content.

8. Termination

We may terminate or restrict your access if:

  • You violate these Terms
  • Meta revokes your account permissions
  • Payments remain overdue
  • Illegal or abusive behavior is detected

You may cancel your subscription at any time.

9. Disclaimers

Ugenc AI provides the Service “as is” without warranties of any kind.
We do not guarantee:

  • Specific engagement results
  • Permanent platform availability
  • Future feature continuity
  • Stability of Instagram/Meta APIs

10. Limitation of Liability

Ugenc AI shall not be liable for:

  • Business losses
  • Account restrictions or bans from Instagram
  • Data loss due to user error
  • Downtime caused by Meta or external services

Our maximum liability is limited to the amount paid in the last 90 days.

11. Governing Law

These Terms are governed by Indian law, including:

  • Information Technology Act, 2000
  • Applicable Consumer Protection laws
  • GST regulations (as applicable to Ugenc AI)
